APPLICANT REQUESTS THAT:

His reenlistment (RE) code of 2C (Entry Level Separation without characterization of service) be changed to RE code 3A (First-term Airman [involuntarily separated] (entry-level) for inability to satisfactorily progress in a required training program, without characterization of service)) to allow him to reenlist in the military. 



APPLICANT CONTENDS THAT:

Although he self-eliminated from the Pararescue Training course, he could excel in a different Air Force career field.  The Air Force is his passion, and he would be glad to do anything the Air Force needs him to do.

STATEMENT OF FACTS:

The applicant initially entered the Regular Air Force on 16 Jul 13.

On 18 Sep 13, as a student during Pararescue/Combat Rescue Officer physical training, he failed the 500 meter freestyle swim (completing in 11:00 minutes instead of the required 10:07), pull-ups (accomplishing 9 of the required 10), and push-ups (accomplishing 49 of the required 52).  

On 25 Sep 13, the applicant self-eliminated from Pararescue/ Combat Rescue Training, seeking to be reclassified in a different Air Force Specialty Code.  The reason he provided for this decision was “Realized this job is not for me.  Feel I could excel at a different career field.”

On 1 Nov 13, the applicant’s commander recommended he be discharged from the Air Force for entry-level performance, specifically, reluctance to make the effort necessary to meet Air Force standards of duty performance.  The case was reviewed and determined to be legally sufficient, and the discharge authority directed his discharge with an ELS on 15 Nov 13.  

On 22 Nov 13, after serving four months and seven days, the applicant was furnished an ELS with uncharacterized  service, and issued an RE Code of 2C and Narrative Reason for Separation of “Entry Level Performance or Conduct.” 

The remaining relevant facts pertaining to this application, extracted from the applicant’s military records, are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C.



AIR FORCE EVALUATION:

AFPC/DPSOA recommends denial, indicating there is no evidence of an error or injustice.  The applicant was discharged for ELS on 22 Nov 13, after serving four months and seven days of service, and received an “uncharacterized” Character of Service.  He also received an RE code of 2C as required by AFI 36-2606, Reenlistments in USAF, based on his involuntary discharge with an uncharacterized character of service.  On 15 Nov 13, the Training Group Commander directed the applicant be discharged for reluctance to make the effort necessary to meet Air Force standards.  Although the applicant is requesting an RE code of 3A—“First-term Airman [involuntarily separated] (entry-level) for inability to satisfactorily progress in a required training program, without characterization of service; or a first-term Airman [involuntarily separated] for failure to progress in military training required to be qualified for service with the Air Force,” he was not separated under 36-3208, Administrative Separation of Airmen, Section 5E—Unsatisfactory Performance, but was separated under Section 5D—Entry Level Performance.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 14 May 14 for review and comment within 30 days (Exhibit E).  As of this date, no response has been received by this office.



THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice.  We took notice of the applicant's complete submission in judging the merits of the case.  While the Board notes the comment from AFPC/DPSOA that the applicant’s RE code of 2C was properly issued as a result of his entry-level separation with uncharacterized service, in our view, such an RE code does not appropriately apply to members, such as the applicant, who were eliminated from initial skills training early during their first term.  In this respect, we note that in accordance with AFI 36-2606, Reenlistment in the Air Force, the RE code of 3A applies when a member is discharged for inability to satisfactorily progress in a required training program.  While we note the applicant is seeking this correction so that he may once again serve in the military, whether or not he is successful in doing so will be based entirely on the needs of the service, provided he is otherwise qualified.  Therefore, we recommend the applicant’s records be corrected as indicated below.



THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was issued a Re-entry (RE) code of “3A” (First term Airman “involuntarily separated” (entry-level) for inability to satisfactorily progress in a required training program without characterization of service; or first-term Airman “involuntarily separated” for failure to progress in military training required to be qualified for service with the Air Force or for performance of primary duties) in conjunction with his entry-level separation with uncharacterized service on 22 November 2013.
